Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wellnoria AB ("Wellnoria," "we," "us," or "our"), a company registered in Sweden, governing your access to and use of the Daily Simmer application, website, and related services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
Our Privacy Policy describes how we collect, use, and share personal data. It is a privacy notice and does not form part of these Terms or treat your acceptance of these Terms as consent to optional data processing.
Accounts and Membership
To access certain features of the Service, you must create an account using one of the sign-in methods offered by the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You must provide accurate, current, and complete information during registration. Providing false, misleading, or fraudulent information may result in immediate termination of your account.
We may suspend, disable, or delete your account where reasonably necessary because you materially violate these Terms, create a security or legal risk, or harm the Service, other users, or third parties. Except where urgent action is needed for security or legal reasons, we will provide notice of the reason and a reasonable opportunity to address the issue where appropriate.
Age Requirement
You must be at least 16 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 16 years old. If we become aware that a user is under 16, we will promptly terminate their account.
User Content and Ownership
Your Ownership Rights
You retain full ownership of all content you create, upload, or generate through the Service, including recipes, notes, images, and AI-generated content created at your direction ("User Content").
Importing does not transfer ownership of anything. When you import a recipe from a page you did not write, the underlying source content stays with its author and platform, and neither you nor Wellnoria acquires rights in it by importing. What the Service saves is the recipe information extracted from that page, kept with a link back to the source. The recipe record in your collection is your User Content for the purposes of these Terms, and your responsibilities below apply to it, but that does not make the original post, article, photography, or video yours.
License to Daily Simmer
By using the Service, you grant Wellnoria a limited, non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and transmit your User Content solely for the purpose of operating, maintaining, and providing the Service to you. You grant this license only for content you have the right to license; you do not grant it over third-party source content that an import happened to draw from. This license terminates when you delete your User Content or your account, except where retention is required for operational backups or legal compliance.
Removal on a Creator Objection or Rights Complaint
Wellnoria keeps a unilateral right to remove imported content. Where a content creator objects to our processing of their personal data, or a creator or platform raises a substantiated rights complaint about retrieved content, we will remove the retained content and information concerned and may stop importing from that source in future. We will do this on a valid objection or complaint, not only at our discretion, and the privacy side of that commitment is described under Article 21 in our Privacy Policy. Where removal affects a recipe in your collection, we will tell you what was removed and why, unless a legal restriction prevents it. No AI Training
We do not use your User Content to train artificial intelligence or machine learning models. Your recipes, images, and other content remain yours and are used only to deliver the Service.
Your Responsibilities
You are solely responsible for the accuracy, quality, and legality of your User Content. You represent and warrant that you have all necessary rights to submit your User Content and that it does not infringe on any third party's intellectual property or other rights.
Shared and Public Content
When you choose to share recipes or collections through the Service, other users will be able to view and access that content. You may revoke sharing at any time by adjusting your recipe or collection settings.
If you enable a public profile or make recipes publicly visible, that content may be accessible to anyone on the internet, indexed by search engines, and displayed on the Daily Simmer public recipe hub. You control what is made public through your profile and recipe visibility settings. Making content public does not transfer ownership, but it does make it broadly accessible beyond the Daily Simmer user base.
AI-Generated Content Disclaimer
The Service uses third-party AI models to generate recipes, cooking instructions, nutritional information, and images. You acknowledge and agree to the following:
- AI-generated recipes and content are provided for informational and entertainment purposes only and do not constitute professional dietary, nutritional, or medical advice.
- You must always verify ingredients for allergies, dietary restrictions, and food safety before preparing or consuming any AI-generated recipe.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated recipes, nutritional information, or cooking instructions.
- AI-generated images are artistic representations and may not accurately reflect the actual appearance of the finished dish.
- If you have food allergies, medical conditions, or dietary restrictions, consult a qualified healthcare professional before relying on any AI-generated content.
Subscriptions and Billing
Plans and Credits
The Service offers Free, Plus, and Premium plans. The Lifetime deal is a one-time purchase that provides Plus access. Free is for individual use only. Plus access, whether subscribed to or bought through the Lifetime deal, may be shared with one additional member for a total of two people. Premium has a larger Family. Current pricing, credit allocations, and feature details for each option are listed on our pricing page.
Credits are consumed when using AI features such as recipe generation and image creation. Recurring-plan credits reset at the beginning of each billing cycle and do not roll over to subsequent cycles. The Lifetime deal includes a monthly credit top-up and a one-time starting credit grant.
Lifetime deal definition: The Lifetime deal provides Plus access to the Service for the lifetime of the Daily Simmer product. It does not grant access for the lifetime of the purchaser. If the Service is discontinued, people who bought the Lifetime deal will receive reasonable advance notice.
On-Demand Credit Packs
All users, including Free tier users, may purchase on-demand credit packs as one-time purchases. On-demand credits are consumed automatically when your plan credits are exhausted. Plan credits are always consumed first. On-demand credits do not expire and persist across billing cycles. On-demand credit packs are non-refundable once purchased and used, except where mandatory consumer law gives you a refund or other remedy.
Payment Processing
Web payments are processed by Polar.sh. Purchases made through the mobile app are processed by Apple or Google, with subscription and entitlement management through RevenueCat. We do not collect or store payment card details directly. Payment information is handled according to the applicable provider's terms and privacy practices.
Auto-Renewal and Cancellation
Subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date. You may manage or cancel a subscription using the billing-management option for the channel where you purchased it. Web subscriptions are managed through the billing portal available from your account settings, while store-billed subscriptions are managed through the applicable app store. Cancellation takes effect at the end of the current billing period.
Pricing Changes
We may change subscription pricing for objectively justified reasons, such as material changes in taxes, inflation, third-party service costs, legal requirements, or the scope of a plan. We will give reasonable advance notice by email or in-app notification. A new price applies no earlier than your next renewal after that notice. You may cancel before the renewal so the changed price does not apply to a later billing period.
Refunds
Refund handling depends on where you made the purchase. Eligible web-purchase refunds are processed through Polar.sh, while mobile-purchase refunds follow the applicable app store's processes and policies. These provider processes and policies do not limit rights you have under mandatory consumer law. Contact support@dailysimmer.com if you request a refund or believe the Service does not conform to our agreement.
Right of Withdrawal
If you are a consumer and enter into a paid contract with us online, you ordinarily have 14 days from the date of the contract to withdraw without giving a reason. The day of the contract is not counted. If the final day is a Saturday, Sunday, Swedish public holiday, Midsummer Eve, Christmas Eve, or New Year's Eve, the deadline continues to the next working day. You may exercise this right by sending a clear statement to support@dailysimmer.com.
For eligible purchases, signed-in users can also use our online withdrawal function on the web or the withdrawal option in the mobile app's account area. After you confirm and submit the request, the Service records the time of receipt immediately, displays a receipt reference, and sends an electronic acknowledgement without delay. Payment or app-store processing may continue separately and does not change when we received your withdrawal.
If you expressly ask us to begin supplying a paid service during the withdrawal period and then withdraw, we may charge a proportionate amount for the service supplied before we received your notice, but only where applicable law permits it and the required information was provided to you.
Mandatory Digital-Service Rights
If you are a consumer, mandatory law may give you rights when the Service is not supplied, does not conform to our agreement, or is modified in a way that negatively affects you. Depending on the circumstances, these may include having the Service brought into conformity, a proportionate price reduction, terminating the contract, receiving a refund, and retrieving eligible content you supplied or created. Nothing in these Terms excludes or restricts those rights.
Subscription Sharing
How Sharing Works
Paid plan subscribers ("Owner") may invite one other Daily Simmer user ("Member") to share their subscription benefits. The Owner manages invitations and membership through the Service.
Shared Credits
Owner and Member share a single credit pool. All AI actions performed by either party draw from the Owner's plan credits. The Owner is responsible for overall credit consumption. There is no per-member credit allocation or guarantee.
Member Requirements
- Members who are currently on a paid individual plan must cancel their existing subscription before joining a shared plan.
- Members cannot independently upgrade their plan while participating in a shared subscription.
Owner Responsibilities
The Owner is responsible for managing their shared plan, its members, and the shared credit pool. If the Owner cancels their subscription or their account is terminated, all Members will be reverted to the Free tier at the end of the current billing period.
Family
What Family Is
Family is a collaborative space where paid plan subscribers can invite others to share recipes, meal plans, and shopping lists. Family is about shared content and collaboration; it is separate from subscription sharing, which governs access to paid plan benefits and credits. The two features can be combined but operate independently.
Roles and Limits
The user who creates a Family is its Owner. All other participants are Members. Each user may belong to only one Family at a time. The maximum number of Family members (including the Owner) is determined by the Owner's subscription plan and is listed on our pricing page.
Content Visibility
All content placed in a Family (recipes, meal plans, and shopping lists) is visible to every Family member. There is no per-item privacy within a Family. Do not add content to a Family that you do not want other members to see.
Content Ownership on Departure
Recipes and other content moved into a Family remain in the Family if a member leaves or is removed. The departing member loses access to all Family-scoped content. Personal content that was never moved into the Family is unaffected.
Owner Responsibilities
The Owner manages membership, invitations, and Family settings. The Owner role cannot be transferred. If the Owner's account is terminated or their subscription is canceled, Family members will lose access to Family features and shared content at the end of the current billing period.
Recipe Import
The Service offers two URL-import paths for supported recipe pages. Basic Import uses a native request and deterministic recipe data at no credit cost. Smart Import may use paid retrieval or AI extraction: Free includes five successful lifetime Smart Import trials, and Plus or Lifetime uses 5 credits for each successful durable recipe. Failed work does not consume a trial or capture credits. Basic Import has no separate count limit beyond the plan's saved-recipe limit; paid plans have no separate Smart Import count cap. Smart Import supports selected social-source pages (including Instagram, TikTok, YouTube, and Facebook) in addition to recipe websites; availability still depends on what a given page allows us to retrieve.
By using the import feature, you acknowledge and agree that:
- You are solely responsible for ensuring that you have the right to import and use content from external sources.
- You submit an import URL for your own personal, non-commercial recipe collection. You are not using Smart Import to scrape, aggregate, or redistribute third-party content at scale.
- When you submit a URL, we act on your instruction to retrieve that specific page; we do not independently browse, select, or monitor a source on your behalf.
- We are not responsible for the accuracy, completeness, or quality of imported recipe data.
- Import access, trials, credit charges, and saved-recipe limits apply as described above and in the current plan information.
- Smart Import may send the submitted URL and retrieved page data to the retrieval or AI providers needed to perform that selected path. Their terms and privacy policies may also apply.
- We retrieve a social-source page anonymously and only as a signed-out visitor sees it. We do not sign in, and an import of a post behind a login wall or age gate fails rather than working around it.
- Content retrieved from a social-source page, including any post content and creator information, remains subject to the rights of its original source and platform. Importing it gives you no ownership of it. You are responsible for how you use it beyond building your personal recipe.
- The recipe record the import creates in your collection is your User Content and is subject to the User Content and Ownership section, which explains what importing does and does not transfer.
- We will remove retained content and may limit future imports of a source when a creator objects or a creator or platform raises a substantiated rights complaint, as described under Removal on a Creator Objection or Rights Complaint above. Assistant Connections
You may connect Daily Simmer to third-party AI assistants, such as ChatGPT or Claude, through our Model Context Protocol (MCP) service. You control whether to authorize a connection and which permissions to grant. An authorized assistant may search for and read recipes that your Daily Simmer permissions allow it to access.
When recipe saving is available, an assistant with authorized write access may submit a structured recipe from its conversation. An assistant may present an additional confirmation step according to the client you use. You are responsible for reviewing any recipe saved through an assistant, including its ingredients, instructions, allergens, dietary suitability, and source rights. The assistant provider's own terms and privacy policy apply to your use of that assistant.
You may revoke a connection at any time at https://mcp.dailysimmer.com/connections. We may limit, suspend, or discontinue assistant connections, including for security, abuse prevention, maintenance, or compatibility reasons. Assistant connections depend on third-party providers and may not always be available.
Prohibited Uses
You agree not to use the Service to:
- Engage in any unlawful, fraudulent, or deceptive activity.
- Violate or infringe upon the intellectual property rights of others.
- Harass, abuse, threaten, or intimidate other users.
- Submit false, misleading, or intentionally inaccurate information.
- Upload, transmit, or distribute malicious code, viruses, or any harmful software.
- Send unsolicited communications, spam, or promotional material.
- Scrape, crawl, or use automated means to access the Service or extract data without our prior written consent.
- Attempt to circumvent, disable, or interfere with security features of the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Use the Service in any manner that could damage, disable, overburden, or impair the Service.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing User Content, suspending or terminating accounts, and reporting to law enforcement.
Intellectual Property
The Daily Simmer name, logo, brand identity, user interface design, application code, and all related intellectual property are owned by Wellnoria AB and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in our intellectual property, except for the limited right to use the Service in accordance with these Terms.
Your User Content remains your property as described in the User Content and Ownership section above.
Backups
We may use backups for operational and disaster recovery purposes, but we do not guarantee that backups are available or that any specific data will be recoverable.
You are solely responsible for maintaining your own backups of any User Content that is important to you. We recommend exporting your recipes and data periodically.
Third-Party Services
The Service relies on third-party providers for infrastructure, authentication, payment processing, and AI capabilities. We are not responsible for any interruption, degradation, or failure of the Service caused by third-party outages, policy changes, or discontinuation. We will make reasonable efforts to mitigate the impact of third-party disruptions but do not guarantee uninterrupted availability of any feature that depends on an external provider.
Disclaimer of Warranty
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THIS DOES NOT EXCLUDE ANY WARRANTY, CONFORMITY REQUIREMENT, OR REMEDY THAT MANDATORY CONSUMER LAW PROVIDES.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.
Limitation of Liability
To the extent permitted by applicable law, Wellnoria AB is not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was made. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer remedies.
Indemnification
To the extent permitted by applicable law, you are responsible for direct losses you intentionally cause through unlawful use of the Service or a material violation of these Terms. This section does not make a consumer responsible for losses beyond what applicable law permits.
Dispute Resolution
Governing Law
These Terms are governed by Swedish law. If you are a consumer who habitually resides in another country, this choice does not deprive you of mandatory consumer protections that apply in that country.
Jurisdiction
Courts with jurisdiction under applicable law may hear disputes arising from these Terms. If you are a consumer, these Terms do not restrict your right to bring a claim in a court available to you under mandatory consumer-protection rules.
Before starting formal proceedings, contact us at support@dailysimmer.com so we can try to resolve the issue. Consumers may also ask the Swedish National Board for Consumer Disputes (ARN) to review an eligible dispute after first giving us an opportunity to respond. ARN's recommendations are not binding.
Exclusion of UN Convention
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Assignment
You may not assign, delegate, or transfer your rights or obligations under these Terms without our prior written consent. Wellnoria may freely assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, without your consent or prior notice.
Changes and Amendments
We may modify these Terms when reasonably necessary, including to reflect changes to the Service, law, security, or third-party dependencies. When we make material changes, we will notify you via email or in-app notification before they take effect where required. Updated Terms will be posted on this page with a revised "Last updated" date.
If a change to a paid digital service negatively affects your access or use beyond a minor extent, mandatory law may give you a right to terminate without charge. Nothing in this section limits that right.
