Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wellnoria AB ("Wellnoria," "we," "us," or "our"), a company registered in Sweden, governing your access to and use of the Daily Simmer application, website, and related services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
Our Privacy Policy describes how we collect, use, and share personal data. It is a privacy notice and does not form part of these Terms or treat your acceptance of these Terms as consent to optional data processing.
Accounts and Membership
Some features require an account. You must provide accurate information, keep your credentials secure, and tell us promptly about unauthorized use.
We may restrict, suspend or terminate an account where necessary to enforce these Terms, protect the Service or others, comply with law, or address a security or legal risk. We provide any notice, reasons and means of redress required by applicable law.
Age Requirement
You must be at least 16 years old to use the Service.
User Content
As between you and Wellnoria, you retain any rights you hold in content you create or submit through the Service (“User Content”). Importing content does not give you or Wellnoria rights in the source material.
You grant Wellnoria a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, process and modify User Content, and to permit our service providers to do so on our behalf, as needed to operate, administer, support, secure, troubleshoot, enforce, maintain and improve the Service. You grant this license only for content you have the right to provide. It continues while the content remains in the Service and as otherwise needed under our Privacy Policy or applicable law.
You are responsible for User Content and must not submit it unlawfully or infringe another person’s rights. We may inspect, restrict or remove content to operate or protect the Service, comply with law, address a rights complaint, or enforce these Terms.
Content you choose to share or publish may be accessible to its recipients or the public, including through search engines. Sharing or publishing content does not transfer ownership.
AI-Generated Content Disclaimer
The Service uses third-party AI models to generate recipes, cooking instructions, nutritional information, and images. You acknowledge and agree to the following:
- AI-generated recipes and content are provided for informational and entertainment purposes only and do not constitute professional dietary, nutritional, or medical advice.
- You must always verify ingredients for allergies, dietary restrictions, and food safety before preparing or consuming any AI-generated recipe.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated recipes, nutritional information, or cooking instructions.
- AI-generated images are artistic representations and may not accurately reflect the actual appearance of the finished dish.
- If you have food allergies, medical conditions, or dietary restrictions, consult a qualified healthcare professional before relying on any AI-generated content.
Subscriptions and Billing
Plans, Prices, and Credits
The Service offers Free access and two paid offers with different commercial models. Cookbook is a one-time purchase of durable core access. Plus is a recurring assistance service. Cookbook ownership and Plus service are independent and may apply to the same account. The plan description and total price shown to you before you place an order govern that purchase.
For direct-web purchases, Cookbook is listed at USD 59.99 as a one-time purchase, Monthly Plus at USD 3.99 per month, Annual Plus at USD 34.99 per year, and the Credit Pack at USD 4.99. The Credit quantity included in a Credit Pack is displayed in the applicable offer before purchase and governs that purchase. Before you place an order, the checkout identifies the seller and applicable currency and displays the total amount payable, including applicable taxes and fees.
Free: Free does not require a paid purchase. It includes a one-time non-expiring starter Credit grant and an expiring Credit allowance for each weekly first-consumption term. A Free user may join a Family but cannot create one.
Cookbook: Cookbook is a one-time purchase and does not renew or create a recurring charge. Cookbook access begins when the purchase is fulfilled and continues for an indefinite term. It has no fixed expiry and does not end merely because time passes.
For these Terms, “Cookbook ownership” means the account-level right to Cookbook access described in this section. It does not transfer ownership of the Daily Simmer software or any related intellectual property.
Cookbook includes every service capability available with Free. It also includes an unlimited recipe library, Family creation for up to six accounts, Family collaboration, and eligible user-requested AI features funded by Credits. Cookbook includes user-requested smart meal planning.
Cookbook includes a one-time non-expiring starter Credit grant and the same weekly Credit allowance as Free. Cookbook does not include Plus sponsorship, recurring automation, or background automation.
Cookbook access may end if the purchase is withdrawn, refunded or reversed, if the account is lawfully terminated, or if the Service is permanently discontinued. Any notice and remedy required by mandatory law applies.
Because Cookbook is a maintained digital service, we may modify its features for objectively justified reasons, including maintaining or improving security, complying with law, preserving technical compatibility or interoperability, adapting to a material change in a third-party dependency, or adding or improving functionality. A modification does not create an additional charge for Cookbook access. We will provide the notice required by applicable law, and any modification remains subject to the Mandatory Digital-Service Rights section and the Changes and Amendments section of these Terms.
Plus: Plus is available as a monthly or annual subscription. While Plus is active, the subscribing account receives access to the complete core recipe manager for the duration of the service. Plus also includes recurring and background automation and the ability to sponsor one Family member with Plus access. A Plus subscription does not by itself grant Cookbook ownership.
Plus provides a larger expiring Credit allowance for each weekly first-consumption term in place of the Free or Cookbook weekly allowance. The subscriber and any sponsored member share that weekly allowance; sponsorship does not create a second allowance or guarantee either user a particular share. Monthly and annual Plus provide the same weekly allowance. Annual billing changes the payment and renewal interval, not the weekly usage term.
Cookbook ownership remains independent when an account adds Plus. If an account owns Cookbook and its Plus service later ends, Cookbook access remains. Ending Plus does not revoke Cookbook ownership.
The Free, Cookbook, Plus, and Plus Preview weekly allowances are alternatives and do not stack. Except for the initial paid Plus term described below, a weekly term remains unopened until its first settled use. For these Terms, a “settled use” occurs when an eligible AI action successfully delivers its result and incurs a Credit charge. The weekly term then expires seven days after that use, and the next term remains unopened until its first settled use.
When a new paid Plus subscription first becomes active, a fresh paid weekly term begins immediately and expires seven days after activation. This reset also applies when an account purchases Plus during a no-card Plus Preview. Any unused Credits in the purchasing account’s current Free, Cookbook, or Preview weekly allowance expire when the Plus allowance replaces it. If the purchaser was sponsored by another subscriber, the purchaser’s access to that sponsoring subscription’s shared weekly allowance ends, but its unused Credits remain with the sponsoring subscription. Other Credit balances are unaffected by this weekly reset and retain their stated expiry terms.
Credits are consumed by eligible AI features, including recipe generation, assisted imports, recipe editing, image generation, smart meal planning, and other AI actions identified in the Service. An eligible AI action consumes Credits based on the measured cost of the work under the charging rules applicable when the action begins and is charged once when it successfully delivers a result for you to review or use. If measured cost is unavailable, the action uses the fallback charge applicable under those rules. Applying a delivered result costs no further Credits. An action that fails before delivery or produces no change is not charged, while a delivered result is not refunded solely because you later discard it or leave it unused. Image generation follows the same delivery-based charging rule but uses a fixed Credit amount for the selected generation mode.
If an action is covered by an included non-Credit use, that included use is applied before Credits. For actions funded by Credits, the current weekly allowance is used first. Other expiring Credits are then used in order of earliest expiry, before non-expiring Credits. Personal Credits purchased through a Credit Pack do not expire.
On-Demand Credit Packs
Where the Service offers the option, an authenticated user may purchase an on-demand Credit Pack. The Credit quantity included in the applicable offer is displayed before purchase.
Purchased Credits belong to the purchasing account, do not expire, and remain with that account through later access changes. They do not become part of another subscriber’s shared Plus allowance merely because the purchaser sponsors or receives sponsorship. A Credit Pack does not unlock a feature that the user’s Free, Cookbook, Plus, or Preview access does not otherwise include.
Except where mandatory consumer law provides a withdrawal, refund, price reduction, or other remedy, a Credit Pack is not refundable to the extent that its Credits have been used.
Plus Preview
An eligible account may start Plus Preview once. Plus Preview is a free, customer-activated access period that lasts for 14 consecutive days from activation.
The current Plus Preview does not require a payment method, does not create a paid subscription, does not renew, and ends automatically without a charge. Starting or using Plus Preview is not a purchase.
During an active Preview, the account may use Plus features other than sponsoring another user. Plus Preview provides an expiring Credit allowance for each weekly first-consumption term. The first term opens on the first settled use and expires seven days after that use or when Preview ends, whichever occurs first. If Preview remains active after a weekly term expires, the next Preview weekly term remains unopened until its first settled use and expires no later than the end of Preview. Unused Credits from a Preview weekly allowance do not roll over and do not become part of a later paid Plus allowance.
When Preview ends without an active Plus subscription, the account returns to its underlying Cookbook or Free access. Starting or ending Preview does not change Cookbook ownership and does not delete the account, recipes, or other User Content.
A Plus purchase made during or after Preview is a separate transaction. The applicable price, renewal interval, first charge, and cancellation terms are shown before that purchase. When the paid Plus subscription becomes active, the new paid term and weekly reset described in Plans, Prices, and Credits apply immediately.
Limited Launch Bonus
A limited Launch bonus may be offered with the first settled direct-web Plus purchase for an eligible billing household. Cookbook and Credit Pack purchases do not qualify.
The Launch bonus is available until and including 23:59:59.999 UTC on August 30, 2027, or until 250 eligible billing households have received it, whichever occurs first. A qualifying Monthly Plus purchase receives the promotional Credit award displayed for Monthly Plus in the applicable offer; those Credits expire 30 days after issuance. A qualifying Annual Plus purchase receives the promotional Credit award displayed for Annual Plus in the applicable offer; those Credits expire 90 days after issuance. The Launch bonus is issued once per eligible billing household and does not recur on renewal.
A Launch bonus may be combined with a separate qualifying referral promotion where the displayed offer permits it. If a qualifying purchase is refunded, disputed, found fraudulent, or otherwise reversed, unused Launch bonus Credits may be reversed. Reversal does not extend the original expiry or create a negative Credit balance for promotional Credits already used.
Payment Processing
For web purchases, Polar.sh acts as merchant of record and authorized reseller. The web product is purchased from Polar under Polar's Buyer Terms, while these Terms govern your right to access and use the Service. Polar handles the web checkout, payment processing, applicable tax calculation and collection, and purchase receipt.
If purchases are offered through an Apple or Google mobile application, the applicable app store processes the purchase and its purchase terms and payment-management process also apply.
Auto-Renewal and Cancellation
Monthly Plus renews for successive monthly billing periods, and Annual Plus renews for successive annual billing periods, unless canceled before the applicable renewal date. The renewal price and date are shown at checkout and in the billing information available for the purchase channel.
You may cancel Plus at any time through the billing-management option for the channel where you purchased it. Web subscriptions are managed through the billing portal available from account settings. A subscription purchased through an app store is managed through that store. Cancellation takes effect at the end of the billing period already paid for unless mandatory law, the applicable seller's terms, or an accepted refund provides an earlier end date. Cancellation alone does not entitle you to a refund for the current billing period, but it does not limit any mandatory withdrawal, conformity, refund, or termination right.
Pricing Changes
A change to the price of Cookbook or a Credit Pack applies only to later purchases.
We may change the Plus renewal price for objectively justified reasons. The change applies no earlier than the first renewal after the notice required by applicable law. You may cancel before that renewal.
Refunds
Refund handling depends on the purchase channel. Refunds for eligible web purchases are processed through Polar. Refunds for purchases made through an app store follow the applicable store's process. Those processes and any voluntary refund policy do not limit rights available under mandatory consumer law.
Contact support@dailysimmer.com if you request a refund, believe the Service does not conform to our agreement, or cannot use the applicable purchase-channel process.
Right of Withdrawal
If you are a consumer entering a paid online contract for the Service, you ordinarily have 14 days from the date of the contract to withdraw without giving a reason.
Polar Software, Inc. is the seller for web purchases. App-store purchases follow the applicable store’s seller-specific withdrawal information.
For a web purchase, you may withdraw through the online withdrawal function or by sending a clear statement to support@polar.sh or support@dailysimmer.com. Sending the statement before the deadline is sufficient.
If you validly withdraw, the applicable seller or payment channel will provide the refund and adjust paid access and Credits as required by law. Withdrawal from a purchase does not by itself delete your account or User Content.
If you expressly request that a paid service begin during the withdrawal period and then withdraw, a proportionate amount may be charged only where applicable law permits it and the required information and request were obtained.

Mandatory Digital-Service Rights
If you are a consumer, mandatory law may give you rights when the Service is not supplied, does not conform to our agreement, or is modified in a way that negatively affects you. Depending on the circumstances, these may include having the Service brought into conformity, a proportionate price reduction, terminating the contract, receiving a refund, and retrieving eligible content you supplied or created. Nothing in these Terms excludes or restricts those rights.
Subscription Sponsorship
How Sponsorship Works
A user with their own active Plus subscription may sponsor one member of the same Family. Sponsorship gives that member the Plus service features available to a sponsored account. It does not give the sponsored member a second sponsorship seat or the right to create a separate Family.
Family membership and Plus sponsorship are separate. Removing sponsorship does not by itself remove the member from the Family, and removing a member from the Family ends that member's sponsorship.
Shared Credits
The Plus subscriber and sponsored member share the current weekly Plus allowance and any promotional Credit balances attached to the sponsoring Plus subscription. Eligible AI actions by either user draw from those shared balances. There is no separate per-member allocation or guaranteed share.
Credits purchased personally through a Credit Pack remain with the purchaser and do not become part of the shared Plus balance merely because the purchaser sponsors or receives sponsorship.
Personal Purchases by a Sponsored Member
A sponsored member may own Cookbook while remaining sponsored. Cookbook ownership and sponsored Plus access apply together.
A sponsored member may also purchase their own Monthly or Annual Plus subscription without leaving the Family. Sponsorship continues while checkout is pending and ends when the member's own Plus subscription becomes active. The member's Family membership and shared Family content remain unchanged.
End of Sponsorship
Sponsorship ends when the sponsoring user's Plus access ends, the sponsor removes the sponsorship, the sponsored member leaves or is removed from the Family, or the sponsored member's own Plus subscription becomes active. Family membership and each user's personal Credits and Cookbook ownership remain governed separately.
Family
What Family Is
Family is a collaborative space in which members can share recipes, meal plans, and shopping lists while keeping separate Daily Simmer accounts. A user with Cookbook, their own active Plus subscription, or an active Plus Preview may create a Family. A Free user may join a Family.
Family collaboration is separate from Plus sponsorship. A Family may exist without a sponsored member, and only a user with their own active Plus subscription may sponsor another member.
Roles and Limits
The user who creates a Family is its Owner. All other participants are Members. Each user may belong to only one Family at a time. A Family may include up to six accounts, including the Owner. The six-account Family limit is separate from the single Plus sponsorship seat.
Content Visibility
All content placed in a Family, including recipes, meal plans, and shopping lists, is visible to every Family member. There is no per-item privacy within a Family. Do not add content to a Family that you do not want other members to see.
Content Ownership on Departure
Family-visible recipes remain owned by the contributing user. When a recipe owner leaves or is removed from a Family, that user's Family-visible recipes become Personal and the former Family loses access. Continued sharing requires an explicit Collection or a deliberately created copy. Nothing is copied or transferred by default. Personal content that was never made Family-visible is unaffected.
Owner Responsibilities and Loss of Access
The Owner manages membership, invitations, and Family settings. A user cannot transfer the Owner role.
If the Owner's Plus access ends but the Owner has Cookbook, Family collaboration remains available and any Plus sponsorship ends.
If the Owner no longer has Cookbook, their own active Plus subscription, or an active Plus Preview, the Family enters a 14-day grace period. After the grace period, collaboration becomes inactive while membership and content are retained so that collaboration can be restored if eligible access returns. Ending paid or Preview access does not by itself delete Family content.
An Owner who deletes their account through the Service must first remove the other Family members. If our authentication provider reports that an Owner's identity has been deleted before they can do that, Daily Simmer removes the deleted Owner, assigns another current member as Owner, and keeps the Family and its remaining recipes inactive for the remaining members. Recipes created by the deleted Owner are removed. This automatic reassignment applies only when the provider-deletion event prevents the Owner from completing the ordinary removal steps.
Recipe Import
Daily Simmer can import recipe information from supported public URLs. Import availability and results depend on the source.
You may use the import feature only for your personal, non-commercial recipe collection. You must use imported content lawfully and respect third-party rights. Do not use the feature to scrape, aggregate, monitor, or redistribute third-party content at scale.
Imported recipe data may be incomplete or inaccurate. Importing does not give you ownership of source content. The User Content section explains the status of submitted and imported content.
Assistant Connections
You may connect Daily Simmer to a third-party assistant and choose the permissions you grant. An authorized assistant may use the Daily Simmer features and content allowed by those permissions, including reading or saving recipes where available.
You are responsible for reviewing content saved through an assistant. The assistant provider’s own terms and privacy policy apply to that assistant.
You may revoke a connection through connection management. We may limit, suspend or discontinue assistant connections, which depend on third-party providers.
Prohibited Uses
You agree not to use the Service to:
- Engage in any unlawful, fraudulent, or deceptive activity.
- Violate or infringe upon the intellectual property rights of others.
- Harass, abuse, threaten, or intimidate other users.
- Submit false, misleading, or intentionally inaccurate information.
- Upload, transmit, or distribute malicious code, viruses, or any harmful software.
- Send unsolicited communications, spam, or promotional material.
- Scrape, crawl, or use automated means to access the Service or extract data without our prior written consent.
- Attempt to circumvent, disable, or interfere with security features of the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Use the Service in any manner that could damage, disable, overburden, or impair the Service.
We may investigate suspected violations of these Terms and inspect relevant account activity and User Content for that purpose. Depending on what we find, we may remove User Content, limit or suspend features, suspend or terminate an account, or report conduct to a competent authority. Nothing in this section limits your mandatory consumer rights. Our Privacy Policy describes how we process personal data during an investigation.
Intellectual Property
The Daily Simmer name, logo, brand identity, user interface design, application code, and all related intellectual property are owned by Wellnoria AB and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in our intellectual property, except for the limited right to use the Service in accordance with these Terms.
Rights in User Content remain governed by the User Content section above.
Backups
We may use backups for operational and disaster recovery purposes, but we do not guarantee that backups are available or that any specific data will be recoverable.
You are solely responsible for maintaining your own backups of any User Content that is important to you. We recommend exporting your recipes and data periodically.
Third-Party Services
The Service depends on third-party providers, and dependent features may be interrupted, changed or discontinued. We do not guarantee the availability of a third-party-dependent feature.
Disclaimer of Warranty
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THIS DOES NOT EXCLUDE ANY WARRANTY, CONFORMITY REQUIREMENT, OR REMEDY THAT MANDATORY CONSUMER LAW PROVIDES.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.
Limitation of Liability
To the extent permitted by applicable law, Wellnoria AB is not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was made. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer remedies.
Indemnification
To the extent permitted by applicable law, you are responsible for direct losses you intentionally cause through unlawful use of the Service or a material violation of these Terms. This section does not make a consumer responsible for losses beyond what applicable law permits.
Dispute Resolution
These Terms are governed by Swedish law. If you are a consumer who habitually resides elsewhere, this does not deprive you of mandatory protections that apply in that country.
Courts with jurisdiction under applicable law may hear disputes. Consumers may ask the Swedish National Board for Consumer Disputes (ARN) to review an eligible dispute after giving us an opportunity to respond. ARN’s recommendations are not binding.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Assignment
You may not assign, delegate, or transfer your rights or obligations under these Terms without our prior written consent. Wellnoria may freely assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, without your consent or prior notice.
Changes and Amendments
We may modify these Terms to reflect changes to the Service, law, security or third-party dependencies. We will provide any notice, termination right or other remedy required by applicable law. Updated Terms will be posted with the revised date.
